Terms of Use

VitieBox (Pty) Ltd (Registration No. 2008 / 019783 / 07) (Vitiebox) is a company which markets and sells vitamin and health products.

NOTE: Please read these terms carefully.  Certain of them (indicated in bold) limit our liability or place liability on you.  If you have any queries, please contact us at support@vitiebox.co.za

1 Acceptance of Terms

1.1 These Terms of use (Terms) are a binding agreement between you, the user, and us, VitieBox.  By using or ordering any products through this website, www.vitebox.co.za (Website) you agree to these Terms.  If you do not agree to these Terms, do not use the Website or place any orders.

1.2 We may unilaterally change these Terms from time to time.  When changes are made, the amended Terms will be available on the Website.  It is your responsibility to familiarise yourself with these Terms and check them regularly for any updates.

2 You will be liable for payment in respect of any orders you place online, except where the order is cancelled in accordance with these Terms.

3 Orders and payment

3.1 Orders may be placed and paid for using the payment portal on the Website.  Note that the product images do not reflect the actual size of the products.

3.2 All product prices are specified, and all transactions will be processed in South African Rands (ZAR).  Your total order price will include the price of the product plus any applicable sales tax.

3.3 The monthly / reoccurring box is subject to a minimum of 3 months subscription before cancellation.

3.4 We reserve the right to change the prices specified on the Website at any time, without prior notice.  If we reduce the price on any shipped products within 7 working days of shipment, you may request a refund of the difference between the price you were charged and the reduced selling price.  To receive the refund, you must contact us within 10 days of shipment.

3.5 We use a third-party payment portal, [Pay Fast Secure Payment Gateway, for online payments.  Use of the portal is subject to their terms, available at https://www.payfast.co.za/end-user-agreement].

3.6 We will not process an order until we receive an order confirmation from you and full payment.

3.7 You may not order products for on selling to a third party.  We reserve the right to cancel any order if we reasonably believe that any products have not been ordered for personal use.

4 Product deliveries

4.1 We currently only deliver within South Africa.  Delivery is free for all orders.

4.2 We use a third-party courier to deliver your products.  We may choose to use an alternative courier at any time.

4.3 Subject to stock availability, acceptance of your order by us and receipt of payment, your order will be processed and delivered as soon as possible, but no later than 7 days from receipt of payment.  You will be asked to specify the delivery address when ordering.

4.4 Delivery within a metropolitan area will typically take place within 5 working days.  Delivery to a regional or remote area will typically take to 7 working days.

4.5 Delivery to very remote areas, not serviced by the courier, will be made to the nearest Post Office In this case we will contact you to make alternative delivery arrangements.

4.6 We do not deliver to farms, military bases, major chain stores, power stations, game reserves, lodges, airports or harbours.  In this case, we will deliver the product to your nearest Post Office and contact you to let you know.

4.7 We will notify you if we are unable to deliver the product within 10 days from receipt of payment.  Within 7 days of this notice, you may cancel the order for the products.  If you cancel the order, we will reimburse you the purchase price.

4.8 Our obligation to deliver a product to you is fulfilled when we deliver the product to the physical address provided by you for delivery.  We are not liable for any loss or unauthorised use of the product after it has been delivered to the physical address provided by you.

5 Product disclaimers

5.1 Certain health products are only to be prescribed by a doctor.  If you have, or the person who will be using the product has, severe allergies, are pregnant or breastfeeding or using any medications, please first consult your doctor or other medical professional before taking any of our products.

5.2 Our products have not been evaluated by the SAHPRA and are not intended to diagnose, treat, cure or prevent disease.

5.3 Our products are intended supplement your diet and should not be regarded as a substitute for a varied diet and a healthy lifestyle or medication of any kind.

5.4 If you are still unsure about which products to purchase, please contact us at support@vitiebox.co.za and we will do our best to assist you.

5.5 Before using any product, please follow all instructions and recommendations on the packaging and/or package inserts.

5.6 We are not liable for any loss, damage or other liability (including death and personal injury) arising from purchasing or use (by you or a third party) of any products other than in accordance with the instructions or recommendations given in an online skin assessment, on the packaging and package inserts or during engagement with us.

6 Returns policy

6.1 Unwanted products

(1) You can return an unwanted product if:

(a) it is unopened, undamaged and unused;

(b) it is in its original packaging; and

(c) you contact us within 5 days of delivery of the products to you.  No returns of unwanted products will be accepted after 5 days,

6.2 If you return an unwanted product, we will refund you the full purchase price or, if you prefer, we will send you a new VitieBox.

6.3 Defective or faulty products

(1) If you receive a defective or faulty product, please inform us as soon as is reasonably possible, within 5 days of delivery.  No returns of defective products will be considered after 5 days.

(2) You must contact us at support@vitiebox.co.za and we will collect the defective product from you at no charge.

(3) After inspection of the defective product and validation of the claim, we will at your election either:

(a) replace or exchange the product; or

(b) refund you the full purchase price.

6.4 For all returns, we recommend that you use a carrier that offers a tracking facility.  If you do not do so and the goods are lost, then no return or refund will be considered.

6.5 When returning a product, you must ensure that:

(1) the product is packaged safely for protection during transportation; and

(2) your reference number is clearly marked on the outside of the parcel.

7 Website disclaimers

7.1 We do not warrant the availability of this Website at all times, including in cases where there is a connection interruption, or the Website is undergoing maintenance or upgrades.

7.2 We do not warrant that the Website is free from errors and viruses or any other malware that has the ability to corrupt your computer or mobile device.  You are responsible for ensuring that your devices have appropriate anti-virus protection.

7.3 Information provided by other users or third parties on the Website may contain links to third party websites that are not owned or controlled by us.  We are not liable for any loss, damage or other liability arising from your use of any third-party websites or for the content, privacy policies, or practices of any third party websites.

7.4 We will take appropriate and reasonable technical and organisational measures to protect information shared over the Website.  We cannot however guarantee the security of transmitting information online to us and you accept the risk of providing information through the Website.

9 Direct marketing

9.1 If you have ordered products from us, we may send you marketing communications and advertisements about our other products and services.

9.2 You may opt out of receiving communications from us at any time by unsubscribing from our mailing list.

10 Limitation of liability and indemnity

10.1 To the extent permitted by law, we will not be liable for any loss, damage or other liability resulting from:

(1) your use of the Website or those of third parties;

(2) your inability to use the Website;

(3) the unauthorised use or disclosure of your personal information by a third party where you have given us permission to share it with them; or

(4) any termination of communications with you.

10.2 You indemnify and hold us harmless against any loss, damage or liability arising from your use of the Website your breach of these Terms or the violation of any law or rights of a third party.

11 Intellectual property

11.1 We and our licensors retain all rights in intellectual property on the Website and in our communications with you, including copyright, trademarks (both names and logos) and registered domain names.

11.2 You may not use, copy or distribute any of this intellectual property without our prior written permission.

12 Notices

Any notice published on the Website or sent to you directly at the email address you provide will be deemed received.

13 General

13.1 No indulgence by us or failure to strictly enforce these Terms is to be construed as a waiver or be capable of founding estoppel.

13.2 Any illegal or unenforceable provision of these Terms may be severed, and the remaining provisions will continue in force.

13.3 These Terms are governed by South African law.
